1. Agreement to Terms

Welcome to BLVCK BANDZ MUSIC GROUP ("BBMG," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of blvckbandz.com and all related websites, mobile applications, services, products, and content provided by BBMG (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

BBMG is a Florida corporation operating under trademark protection. Our Services encompass music production and distribution, educational programs through BBMG Academy, merchandise sales, and related creative offerings.

2. Eligibility

You must be at least 18 years old to use our Services independently. Users between 13 and 17 years old may use the Services only with the involvement and consent of a parent or legal guardian.

For BBMG Academy enrollment, additional age and eligibility requirements may apply as specified in the respective program documentation.

3. Account Registration

Certain Services may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Intellectual Property Rights

4.1 BBMG Content Ownership

All content available through the Services—including but not limited to text, graphics, logos, audio samples, video content, musical compositions, sound recordings, course materials, software, and trademarks (collectively, "BBMG Content")—is the exclusive property of BBMG or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The BLVCK BANDZ MUSIC GROUP name, logo, "Harmonic Empire," and all related marks are trademarks of BBMG. Unauthorized use of any BBMG trademarks is strictly prohibited.

4.2 Limited License to Users

Subject to your compliance with these Terms, BBMG grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. This license does not include any right to:

• Reproduce, distribute, publicly display, or create derivative works from BBMG Content
• Download or copy materials except where expressly permitted
• Use content for commercial purposes without written authorization
• Reverse engineer, decompile, or disassemble any software or technology

4.3 User-Generated Content

If you submit, upload, or post content to our Services ("User Content"), you retain ownership of your intellectual property rights. However, you grant BBMG a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and promoting the Services.

You represent and warrant that you own or have obtained all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

5. BBMG Academy Specific Terms

5.1 Educational Services

BBMG Academy provides online and hybrid educational programs in music production, sound design, business strategy, and related disciplines. Enrollment in Academy programs is governed by these Terms and any additional program-specific agreements.

5.2 Tuition and Payment

All program fees must be paid in accordance with the published payment schedule. Fees are non-refundable except as specified in our Refund Policy or as required by applicable law.

5.3 Certification and Credentials

Successful completion of Academy programs may result in certification. Certifications are awarded at BBMG's sole discretion based on performance criteria. Certificates do not constitute professional licenses or accreditation by external bodies.

5.4 Course Materials

All course materials, including but not limited to the "Sound of the Stars: Elite Producer's Bible," proprietary methodologies, templates, and instruction videos, are confidential and proprietary to BBMG. Students may not reproduce, distribute, or commercialize Academy materials without express written permission.

6. E-Commerce and Merchandise

6.1 Product Availability

All merchandise, music products, and services are subject to availability. We reserve the right to discontinue any product or service without notice.

6.2 Pricing and Payment

All prices are in United States Dollars (USD) unless otherwise stated. We reserve the right to modify pricing at any time. Payment processing is handled by secure third-party providers, and your use of such services is subject to their respective terms.

6.3 Shipping and Delivery

Shipping terms, costs, and estimated delivery times will be provided at checkout. Risk of loss and title for physical goods pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers or customs authorities.

6.4 Returns and Refunds

Physical merchandise may be returned within 30 days of delivery if unused and in original condition. Digital products, music downloads, and Academy enrollments are generally non-refundable. See our Refund Policy for complete details.

7. Acceptable Use Policy

You agree not to use the Services to:

• Violate any applicable federal, state, local, or international law or regulation
• Infringe upon or violate the intellectual property rights of BBMG or any third party
• Harass, abuse, threaten, or intimidate any person
• Submit false, misleading, or fraudulent information
• Engage in unauthorized advertising, promotional materials, spam, or solicitation
• Transmit viruses, malware, or any code of a destructive nature
• Attempt to gain unauthorized access to any portion of the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Scrape, data mine, or use automated systems to collect data without permission
• Impersonate BBMG, its employees, or other users

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

BBMG DOES NOT WARRANT THAT:

• The Services will function uninterrupted, secure, or error-free
• Defects will be corrected
• The Services or servers are free of viruses or harmful components
• Results obtained from the Services will be accurate or reliable

BBMG Academy programs are educational in nature. We do not guarantee employment, income, success, or specific career outcomes resulting from participation in our programs.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BBMG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL BBMG'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO BBMG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless BBMG, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content or conduct in connection with the Services
• Any misrepresentation made by you

11. Third-Party Links and Services

The Services may contain links to third-party websites, advertisers, services, or resources. BBMG is not responsible or liable for:

• The availability or accuracy of such websites or resources
• The content, products, or services available from such websites or resources

Links to third-party sites do not imply endorsement by BBMG. You access third-party sites at your own risk and subject to their terms and policies.

12. Modification and Termination

12.1 Modification of Terms

BBMG reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

12.2 Modification of Services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice or liability.

12.3 Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

13.2 Jurisdiction

You agree that any legal action or proceeding between you and BBMG shall be brought exclusively in the federal or state courts located in Florida, and you irrevocably consent to the personal jurisdiction and venue of such courts.

13.3 Dispute Resolution Process

Before filing any legal claim, you agree to contact BBMG and attempt to resolve the dispute informally by sending written notice to legal@blvckbandz.com. We will attempt to resolve disputes through good-faith negotiation.

13.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Digital Millennium Copyright Act (DMCA)

BBMG respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our Services, please notify our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the allegedly infringing material and its location
• Your contact information (address, phone number, email)
• A statement that you have a good-faith belief that use of the material is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms specific to particular Services, constitute the entire agreement between you and BBMG regarding the Services.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be removed and the remaining provisions will remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

15.5 Force Majeure

BBMG shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

15.6 Export Control

The Services and underlying technology may be subject to U.S. export control laws. You agree to comply with all applicable export and re-export control laws and regulations.
